ZiviBloom respects the intellectual property rights of others and expects the same from everyone who uses our website. We respond to valid notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
1. Filing a DMCA notice
Your written notice must include all of the following:
- Your full name, address, phone number and email, plus your physical or electronic signature.
- A description of the copyrighted work you claim has been infringed.
- The exact URL(s) of the page(s) on our website containing the material you want removed.
- A statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.
2. Where to send it
Notices that do not include the information above may not be actionable.
3. What happens next
After receiving a valid notice, we will remove or disable access to the material and may notify the person who posted it. We aim to act within a reasonable time, usually within a few business days.
4. Counter-notice
If you believe material was removed by mistake or misidentification, you may send a counter-notice to the email above containing:
- Your name, address, phone number and email, plus your signature.
- Identification of the removed material and where it appeared before removal.
- A statement under penalty of perjury that you believe in good faith the material was removed by mistake or misidentification.
- A statement that you consent to the jurisdiction of the federal court for your address and will accept service of process from the person who filed the original notice.
If we receive a valid counter-notice, we may restore the material in 10 to 14 business days unless the original complainant notifies us that they have filed a court action.
5. Repeat infringers
In appropriate circumstances, we will terminate the access of users who repeatedly infringe the copyrights of others.
6. Misrepresentation
Under Section 512(f) of the DMCA, anyone who knowingly makes a material misrepresentation that content is infringing may be liable for damages, including costs and attorney’s fees. Please make sure your claim is valid before submitting it.
